Internal complaints channel

El Consejo General of the Abogacía Española in compliance with Law 2/2023, of February 20, regulating the protection of people who report on regulatory infractions and the fight against corruption, has developed and implemented the internal information management system of the Advocacy, and within this system it has implemented the internal channel of information, available to those people who, being linked to this Consejo General, want to report possible irregularities and acts of corruption in a confidential and protected manner.

In accordance with the principles of transparency and safeguards contemplated in the law, this channel guarantees the confidentiality of the identity of the person who wants to inform, as well as the prohibition of retaliation and protection against adverse consequences derived from the complaint. All reports received will be treated with the utmost seriousness and confidentiality, and the necessary measures will be adopted to investigate and punish any regulatory violation or act of corruption reported fairly and effectively.

The objective of this reporting channel is to provide people with a safe and trustworthy space where they can make their voices heard and contribute to the fight against corruption. Through this whistleblowing channel, all those who have relevant information on possible regulatory infractions or corrupt acts are invited to speak up and provide their testimony responsibly. Together, we can build a fairer and more upright society, where ethical values ​​prevail and corruption in all its forms is actively combated.

The Information (Complaint) can be made with the identification of the informant (complainant), or even anonymously. Keep in mind that if you opt for anonymity, the reporting person will not be able to receive information on its evolution, but will only be able to see the progress of their status, directly accessing the follow-up option with the ID that will be provided to the end of sending the Information (Complaint).

Keep in mind that both the informant and the people affected by the complaint will have the right to preserve their identity, under the terms provided in article 32 of Law 2/2023, of February 20. In addition, informants have a series of rights, when the information they provide meets the requirements of articles 2 and 35 of that standard, among which destaca the prohibition of reprisals (article 36). It also considers the support and protection measures against reprisals that the Law includes in its articles 37 and 38.

However, also take into account that "publicly communicating or revealing information knowing that it is false" is considered a very serious offense and that the Law provides for a fine of between 30.001 and 300.000 euros for natural persons who commit it [articles 63.1.f) and 65.1.a) of the aforementioned Law].
