History of Spanish Law

Origins of the Council

The origins of Consejo General of the Abogacía Española go back to the year 1942, when the then dean of the Zaragoza Bar Association, Emilio Laguna Azorín, addressed a communication to all his members and to the Madrid Bar Association in which he summarized the serious situation of the Abogacía Española in the postwar period. At the end of the same year this communication was sent to all the deans of Spain.

Thus began a series of contacts for the creation of a higher body that would enable a coordinated action of the Colleges, give greater importance to the profession and the presence of the Legal Profession in the legislative renewal.

The idea was widely accepted and the then dean of Madrid, Antonio Goicoechea, at the proposal of Zaragoza, took over the direction of the project. The main objectives were the removal of any type of impediment to the professional intervention of lawyers before all courts and jurisdictions and the creation of a Mutual Fund whose purpose was to grant pensions to orphans and widows of lawyers, as well as subsidies to those affected by "Physical or intellectual uselessness, or disabled for work due to their old age."

The Creation

The idea was approved by the Ministry of Justice, and by Decree of June 19, 1943, what was then called Consejo General of the Illustrious Bar Associations of Spain, which received its first composition by Ministerial Order of October 14 of the same year.

Throughout the history of the Council, the National Congresses of the Legal Profession have been authentic renovating events. The main changes experienced by the Council, both in its functions and in its composition, took place after the IV Congress, held in León in June 1970. General Statute of the Legal Profession

The approval of the current General Statute of Abogacía Española by Royal Decree 135/2021, of March 2, collects the spirit of defense of the rights and freedoms of citizens. In recent years, the Council has had a decisive participation in the drafting of various laws that update the profession: Access Law - demanded by the Legal Profession since 1917-; Law of Professional Societies and regulation of the Special Labor Relationship; reform of the Law on Professional Associations derived from the Services Directive; the successive reforms of the Civil Procedure Law or the Penal Code, etc. In addition, the Council has promoted the training of lawyers and the generalization of the implementation of new technologies through the Technological Project of the Legal Profession, and has achieved achievements such as procedural inability on Saturdays.

National Congresses

The National Congress of the Legal Profession is held every four years and is the most important event for the Legal Profession.
