Royal Decrees of declaration and extension of the state of alarm Legal nature, jurisdictional control and patrimonial responsibility
The purpose of this paper is to succinctly analyze three specific aspects of the Royal Decrees by virtue of which the state of alarm contemplated in article 116.2 of the Spanish Constitution is declared and, where appropriate, extended. First, their legal nature as provisions with force of law. Second, its jurisdictional control by the Constitutional Court through the issue of unconstitutionality and the appeal for amparo. Finally, some notes are made about the patrimonial responsibility derived from the aforementioned Royal Decrees.
