The new professional opportunities for the legal profession brought about by the creation of the position of conciliator, as one of the MASC provided for to comply with the procedural requirement established in Organic Law 1/2025, of January 2, on measures regarding the efficiency of the Public Service of Justice, makes it necessary and essential to establish basic training guidelines that will serve the conciliating lawyer for his professional work, since technical or legal knowledge related to the matter in question is required, and to be able to manage an activity aimed at reaching a conciliation agreement.

Among the requirements to act as a mediator are being registered as a practicing mediator with one of the professional associations of lawyers, solicitors, social graduates, economists, notaries, or property registrars, as well as, where applicable, any other legally recognized association; or being registered as a mediator in the corresponding registries or belonging to duly approved mediation institutions.

In order to guarantee and position the legal professional, the Consejo General de la Abogacía Española makes this training course available to all members.

As is known and has been extensively discussed in the monographic sessions organized by this Consejo General In the first half of 2025, the admissibility requirement requires proof of an attempt at negotiation prior to filing the claim, which may well be proven through an attempt at conciliation.

Private conciliation, regulated in Article 15 of the aforementioned Organic Law, is one of the most important means of dispute resolution in the face of the new legal landscape and the new procedural paradigm to which we are adapting. The functions legally assigned to the conciliator are neither few nor simple, hence the need to strengthen technical knowledge to fully address this new role.

The private conciliation process has a specific structure, ranging from an initial information session for the parties, in which the characteristics of conciliation, its cost, and organization are explained, to the eventual achievement, or failure, of a settlement—full or partial—on the dispute at hand. This is neither possible nor advisable without the legal and technical knowledge derived from specific training in the subject, which is the objective of this course for legal professionals who wish to practice as private conciliators.

It is in conciliation that one of the highest values ​​of legal practice is manifested. Based on this foundation and developing the content established in legal regulations, the aim is to provide specific training for the professional practice of conciliation. This training will equip individuals for this activity in the area of ​​specialization in which the service is provided and, specifically, will demonstrate knowledge of the legal framework, psychological aspects, ethical aspects of the process, and communication, negotiation, and conflict resolution techniques.

OBJECTIVES

To provide students with the necessary skills to act as private mediators, also offering them the necessary ongoing training through:

  • The development of the necessary skills.
  • The necessary learning to use the most appropriate tools and techniques for each specific matter.

The training provided is aimed at: on the one hand, those new to the field of conciliation, and on the other, those who wish to continue their training and specialization in the subject through 20 hours of predominantly practical content.

methodology

The entire course is designed as a theoretical and practical presentation, drawing on the speakers' professional experience.

evaluation and control

The teaching staff will be evaluated directly by the teachers, and a final test will be administered. Attendance and achievement are monitored.

At the end of the course, certificates of achievement will be issued, in accordance with current legislation.

Tuition and registration costs

Registration costs €100, which must be paid before the course begins.

The registration fee will be refunded if the course is postponed or if the new start date is not to the student's liking.

A minimum of 80% live attendance is required; the remaining 20% ​​may be viewed on demand.
